On the 1st of August 2022, the new Articles XI.216/1 to XI.216/3 of the Code of Economic Law (“CEL”), implementing Article 15 of the Directive (UE) 2019/790 (also known as the “DSM Directive”) into Belgian law, entered into force.
From now on, any Information Society Service Provider (“ISSP”) (and among them, the media monitoring services and news aggregators, such as Google and its ‘Google News’ service) that wants to online use press publications of less than two years-old shall in principle only be allowed to do so with the press publisher’s prior consent and, if applicable, upon payment of royalties.
